Gay sex is now legal – Supreme court ends gay sex ban

Mumbai, India- What had continued since the colonial-era time has been decriminalized today by the top court of world’s largest democracy.

India saw a historic ruling on 6th September 2018 with a panel of five judges together issuing the right to equality and dignity for the LGBT community in India.

Gay sex was considered a taboo by the Indian society and further went onto become criminal offence. Section 377 of the Indian Penal Code that was introduced during the British colonial era criminalized same sex individuals engaging in sexual intercourse. Gay sex was deemed to be against the natural accordance of this world and was punishable upto 10 years in jail.

The LGBT community found this to be a violation of the fundamental rights of individual given by the democracy. LGBT activists filed petition in court spanning over hundreds of pages describing the closeted lives they had to live. It highlighted the abuse, depression, persecution and blackmail they have to go through due to the inhumane law.

Even though in recent years more and more Indians have come out of the closet and proudly accepted their sexual identity, the stringent laws created shame for many others who were struggling with their identities.

This epic news marked the victory of a long battle for the rights of individuals in this country who were living in deep-rooted fear and trauma.

India’s chief justice, Dipak Mishra upholded that Section 377 was “irrational, indefensible and manifestly arbitrary” and that the essence of true liberty lies in respecting individual choices and this freedom can only be fulfilled when each of us believe that LGBT community owns equal rights too.

He further stated that, Section 377 violated the right to equality and was being used as a weapon of discrimination among individuals.

This history-making decision will have mark a change for the Lesbian, Gay, Transgender and Bisexual community in a country of 1.3 billion individuals.
